Pursuant to N.D. Admin. Code §§ 115-05-01-03 and 115-05-01-06, a director, officer, commissioner, head, or other executive involved in a quasi-judicial proceeding must disclose information that has potential to create an appearance of bias. The individual must disclose the required information on this form and attach relevant documentation.
The neutral reviewer or director, officer, commissioner, head, or other executive shall document the facts and decision regarding any disclosure. Upon completion, the neutral reviewer or director, officer, commissioner, head, or other executive shall provide a copy of the documentation and this form to the Ethics Commission.
Departments, agencies, boards, commissions, or public entities shall document in the official minutes of a proceeding, if applicable, that a director, officer, commissioner, head, or other executive has recused from any further involvement in the matter.
